You may also have to go to jail if the cheque bounces. A bounced cheque is also known as a Dishonored Cheque.
Dishonored Cheque is also known as Cheque Bounce-
A bounced cheque is also known as Dishonored Cheque (Dishonored Cheque kya h). Cheque bouncing is not a trivial matter because according to section 138 of the Negotiable Instruments Act 1881, it becomes a punishable offence (is Cheque Bounce a crime). For which not only a fine but also a jail sentence can be given.
Reasons for Cheque Bounce-
There are many reasons why a cheque can bounce. For example, there is not enough balance in the bank account (bank account rules) or the balance is not enough for the amount of the cheque, the signature does not match, the cheque is less (Cheque Bounce reason), making a mistake in the words while filling the cheque, overwriting, bank account being closed, being a fake cheque (Cheque ke niyam) or not having the seal of the company, due to which the cheque bounces.
This is how you can correct it-
Whenever your check bounces, you are given a chance by the bank (latest bank update) to correct it. If you do not correct your mistake even in that time, then you have to face legal proceedings if the check bounces (Cheque Bounce kyu hota h).
The amount has to be paid in this time if the check bounces-
Whenever your check bounces (Cheque Bounce ke niyan), you are informed about it by the bank. After this, you have three months’ time so that you can deposit another check in place of the bounced check. If your second check also bounces (Cheque Bounce reason), then legal action can also be taken against you.
You may have to pay a fine-
After the check bounces, the bank also charges a fine. The amount of the fine may vary according to the reasons.
Know when a case can be filed-
The legal process on Cheque Bounce cannot be started immediately after the cheque bounces. First, a notice is sent by the bank. If no response is received from the debtor even within 15 days, then the debtor can resort to the legal process.
This much jail will be there if the cheque bounces-
When the debtor does not pay the amount after the cheque bounces, he can also be jailed for 2 years. Apart from this, the bank can also ask to pay the fine (fine on Cheque Bounce). Or both the punishments can be given.
